HKIC Human Resources Services (HKIC) Circular to Applicants relating to Personal Data (Privacy) Ordinance (“Ordinance”)
  1. From time to time, It is necessary for applicants to supply HKIC with data e.g. HKID No., full name, and address (according to Point No.21 of Part XII of Chapter 57 of The Employment Ordinance) in connection with the registration or continuation of registration and the provision of recruitment services
  2. Failure to supply such data may result in HKIC being unable to register or continuation of registration and provision of recruitment services
  3. The purpose for which data relating to a customer may be used are as follows:
    - Verification of identity and prevention of fraud of the recruiting procedures;
    - Conducting reference check with ex-employers whenever it is approved by the applicant, which records may be used by other organization in making employment decision about an applicants;
    - Designing recruitment programs or other related products for applicants’ use;
    - Marketing recruitment services or related training by HKIC and any of its branches; and
    - Purpose relating to any of above.
  4. Data held by HKIC relating to an applicant will be kept confidential but HKIC may provide such information, for the purposes listed in paragraph 2 above, to:
    - Any affiliate, agent, contractor or third party service provider who provides marketing administrative, telecommunications, computer, payment or securities clearing or other services to HKIC in connection with the operation of the business;
    - Any other branches of HKIC;
    - Selected business partners of HKIC, for the purposes set out in paragraph C4 above only;
    - Any other person under a duty of confidentiality to HKIC including a group of company of HKIC, which has undertaken expressly or impliedly to keep such information confidential; and
    - Any person, pre-employers to who HKIC is under an obligation to make disclosure under the consent of applicant on any employment reference check purpose.
  5. Under and in accordance with the terms of the Ordinance and the guidelines issued pursuant thereto, any individual has the right:
    - To check whether HKIC holds data about him / her and of access to such data;
    - To require HKIC to correct or delete any data relating to him/her which is inaccurate;
    - To ascertain HKIC’s policies and practices in relation to data and to be informed of the kind of personal data held by HKIC;
    - In relation to applicant reference check, to request to be informed which items of data are disclosed to reference check related parties, and be provided with further information to enable the making of an access and correction request to the relevant reference check parties; and
    - To choose his personal data are not used for marketing purposes; this includes receiving marketing material from HKIC (whether or not originated by HKIC) and disclosing information about you to another company and or selected business partners for recruitment / training marketing purposes.
  6. The person to whom requests for access to data or correction of data or for information regarding policies and practice and kinds of data held are to be addressed as follows in writing to: The Data Protection Officer, The HKIC Human Resources Services, 17/F, Rammon House, 101 Sai Yeung Choi St South, Kln, Hong Kong
  7. Nothing in this Notice shall limit the rights of customers under the Personal Data (Privacy) Ordinance.
  8. In case of discrepancies between the English and Chinese versions, the English version shall apply and prevail.
